Trespass Warning Card
While AGC supports their right to lawfully organize employees, unions – with few exceptions – have no right to enter or block access to construction projects on private property. According to attorney James Winkler of Littler Mendelson: “Nevada law makes it a misdemeanor for a person to willfully enter or remain on another person’s land after having been warned by the owner or occupant not to trespass…Nevada law provides that if a property is fenced, that it will be presumed that the person has been warned not to enter.”
Unfortunately, these illegal and provocative tactics seem to have become more common in recent months.
Illegal trespass and blocking construction sites escalate tensions on job sites and can easily lead to violence if allowed to continue. It is important to document any such illegal activities and to prosecute the perpetrators.
The Las Vegas Metropolitan Police Department has developed a Trespass Warning Card to aid in tracking and documenting warnings issued to trespassers. To combat illegal trespass during bannering campaigns, labor disputes, picketing or organizing activity, follow these instructions from Metro Captain Valerie Juick:
- Obtain Trespass Warning Cards from any Metro area command substation. Identify yourself to receive the cards. Photocopy them as needed in the future.
- Keep the cards on file. When trespass occurs, read them the card verbatim, including the text of Nevada Revised Statute 207.200 at the bottom.
- Give the trespasser the opportunity to leave the property peacefully after being informed that he is subject to citation and/or arrest if he remains on private property. If the trespasser leaves, keep the completed Trespass Warning Card on file.
- If the trespasser fails to leave after the warning is read, call Metro dispatch at 311, and officers will respond.
